Terms 1. Coming into Force This agreement comes into force when you click the [Agree] button on this page. The effective date of this agreement is the date when you click the [Agree] button on this page. 2. Property Copyright and property in the ICC Profiles (including Profiles relating to both coated an uncoated media), logo, name and all literature and intellectual property belong to Roland and its licensor. You must not: A. copy the ICC Profiles, or any of its support file, program module or literature, or communicate any of these materials to a third party, without Roland's consent; or B. reverse engineer, disassemble, decompile or make any other attempt to discover the source code of the ICC Profiles. 3. Bounds of Licence 3.1 Roland does not grant you the right to sub-license, rent, assign or transfer the right granted under this agreement nor the ICC Profile itself (including the accompanying items) to any third party. You may not provide use of the ICC Profiles through time-sharing service and/or network system or in any other way to any third party. 3.2 Uncoated media and ICC Profiles A. You may use the ICC Profiles only with Roland Inkjet Printers with Roland software known as RIP. B. If you request support in relation to any Roland equipment, and Roland determines that the problem is not caused by a defect in the ICC Profiles, then Roland may charge you for responding to the service call and carrying out any diagnostic and rectification work, on a time and materials basis. Roland may decide not to provide support where defect or fault is caused by use of third party materials including uncoated materials. 4. Reproduction You may make one copy only of the ICC Profiles for back-up purposes. The copied software remains the property of Roland. 5. Cancellation Roland may terminate this agreement without notice if: A. you are in breach of this agreement, and fail to rectify that breach within 14 days of being required by Roland to do so; or B. you breach any obligation of good faith regarding this agreement. 6. Limitation of Liability Roland may change the specifications of the ICC Profiles without notice to you. Roland will not be liable to you for any damage that may be caused by the use of the ICC Profiles or by exercise of the right licensed by this agreement. Roland does not warrant that third party materials will give the same results achievable as with materials provided by Roland. The ICC Profiles contain information based on the performance of media and ink provided by Roland. Roland does not warrant that the same results are achievable using third party materials. If you request a service call in relation to any Roland equipment, and Roland determines that the problem is not caused by a defect in the ICC Profiles, then Roland may charge you for responding to the service call and carrying out any diagnostic and rectification work, on a time and materials basis. 7. Governing Law This agreement is governed by the laws of New South Wales, and the parties shall submit to the exclusive jurisdiction of the Courts in New South Wales. Disclaimer 8. All content and other services on this website are provided in good faith and we will use reasonable endeavours to ensure that they are accurate and current as at the date of publication. However, to the extent permitted by law, we make no warranty as to the reliability, accuracy or completeness of the content and services on this website. You use the content and services contained in this website at your own risk. 9. To the extent permitted by law, all warranties, conditions and representations about this website and the ICC Profiles, the availability of this website for access and use, the ICC Profiles advertised, or those supplied in this website and the information provided on the website are excluded. 10. If a term is to be implied by law into these Terms then our liability for breach of such term will, to the extent permitted by law, be limited, at our option, to one or more of the following: A. in relation to goods, the repair or replacement of the goods or supply of equivalent goods, or the payment of the cost of repairing or replacing the goods or acquiring equivalent goods; or B. in relation to services, the supply of the services again or the payment of the cost of having the services supplied again. 11. To the extent permitted by law, neither we nor any of our officers, employees, agents or related bodies corporate will be liable in any way (including for negligence) for any loss, damage, costs or expenses suffered by you or claims made against you in connection with: the use of this website; A. any lack of availability, interruption, delay in operation, virus, Internet access difficulties, or equipment malfunction in relation to this website; B. the downloading of each ICC Profile; C. the use of an ICC Profile other than as directed by us; D. our failure to provide an ICC Profile; or E. the operation of our equipment other than as directed by us, or with third party media, inks and other materials which have not been specifically authorised by us.
